4.1. The Buyer may not exercise the right of withdrawal for contracts regarding the delivery of goods that are **perishable or may expire quickly** (such as chocolate, Turkish delight, etc.). In addition, the right of withdrawal cannot be exercised in the cases listed under Article 7.7. For other products, the Buyer may exercise the right of withdrawal within **fourteen (14) days** from the date of delivery of the Product/Service without incurring any legal or penal liability and without providing any justification. The Buyer may exercise this right by either “order cancellation” or “return”. If the order has not yet been handed over to the courier, the Buyer may cancel it through the Platform or by contacting customer service. After the order is delivered, the Buyer may return it at the door or initiate the return process by contacting customer service to obtain a return code.
4.2. The Buyer shall inspect the Product prior to receipt and shall not accept delivery of any defective or damaged Product/Service (e.g., crushed, broken, spoiled, packaging opened or torn) that can be identified through ordinary inspection. If the Buyer neglects this inspection and accepts the delivery, the Product/Service will be deemed to have been delivered in good condition and undamaged.
4.3. The Buyer must notify the Seller of their intention to exercise the right of withdrawal within **fourteen (14) days** following the receipt of the Products, via the postal address, telephone number, e-mail address provided in the Seller's contact information, or through other means available on the Platform. The Buyer may either use the sample withdrawal form attached to the Agreement or submit an explicit statement declaring their decision to withdraw.
4.4. Following the notification of withdrawal, the Buyer must return the Product to the Seller or to the person authorized by the Seller within **fourteen (14) days** at the latest, together with the original invoice, box, packaging, standard accessories, and any complimentary items that were sent with the Product, in full and undamaged condition. If the Buyer fails to use the Product in accordance with the instructions for use during the withdrawal period, they shall be liable for any changes or deterioration in the Product.
4.5. Provided that the Product has been returned in the manner specified above, the Seller shall reimburse all payments collected from the Buyer within **fourteen (14) days** from the date on which the withdrawal notice was received, using the same payment method used by the Buyer at the time of purchase, and without imposing any additional costs or obligations on the Buyer. In the case of payments made by credit card, the Buyer acknowledges, declares, and undertakes that the timeline for the refund to be reflected in their account is subject to the internal procedures of the bank and that the Seller cannot be held liable for any delays or consequences related to the banking process after the refund is initiated by the Seller.
4.6. If the Buyer returns the Product/Service via the Seller’s contracted Cargo Company/Courier specified in the Preliminary Information Form, the **return shipping cost shall be borne by the Seller**. If the Seller’s Cargo Company or Courier does not have a branch or representative in the Buyer’s location, the Buyer may return the Product using any other cargo company/courier. In this case, the return shipping cost and any damages incurred during the transportation of the Product shall be the responsibility of the Seller.
4.7. All returns must be made using the original packaging and box, and the Product must be returned without damage to the packaging.
The Buyer may submit any questions, requests or complaints to the Seller via the address specified in Article 1, the e-mail address **info@themarmarahotels.com**, or the customer service line **+90 212 334 83 84**. Furthermore, within the scope of the Distance Sales Agreement, the Buyer may apply to the Consumer Arbitration Committees or the Consumer Courts located in the place of purchase of the goods or services or in the Buyer’s place of residence, provided that the monetary limits set by the Ministry of Trade each December are not exceeded.
